Terms of Service [T.O.S]
1. COMISSION
By comissioning me in any way, you agree to all the conditions below.Do not trace, steal, edit or claim my work as your own.
I own the rights to these works & I have the right to publish them on my social networks for self-promotion and other purposes.
However I won't resell your commission or use it commercially in any way.
Still, you need to give me credit when using my works anywhere online or offline. More below under 7. COPYRIGHT/USAGE POLICY❥ Animation commissions: I only animate existing emotes!
I will also not alter the original design and add anything to it.
Please make sure the original artist agrees upon me animating them, otherwise I can't work with them.
Also please mention who the original artist is so you and I can give them proper credit.
❥ Personal Use Commissions: You cannot resell my art, make merch or any source of income with it. You must buy a licence from me for doing so.
❥ Commercial commissions: not available yet.Breaking the terms and conditions will result in permanent blacklisting you from my commissions.
2. GENERAL TERMS
I have the right to decline any commission.
Any ill behaviour will not be tolerated and the commission will be cancelled if the client fails to comply with the rules provided.References must be given when requesting a commission. If not, it will lead to an uppricing.Finished commissions will be uploaded on Artisttree, send per Mail or if you wish so, uploaded in an Google Drive File only you have access to.
You are free to contact me for changes or if you want to add something to your commission.When comissioning me you agree to keeping our personal Data private and only between the both of us. If you Dox me in any way I will press legal charges against you.
3. PROCESS AND DELIVERY
Under the Button How to Order on the Top of this Website you can check how ordering me on Artisttree in Detail works!All commissions are completed on a first come first serve basis unless I arrange them differently of interest.
Before proceeding with a request, I will contact you to confirm the order.The time it takes to finish an commission varies 1 week - 3 or 6 months depending on factors such as health, the complexity of the commissioned piece and other work.
I would also like to note that my working hours are bound to my freetime. This means that I can take breaks whenever needed and will continue with the commissions once I can.You can track the process of your request on Artisttrees Dashboard or my Trello and I will keep you updated with WIPs (Sketches) for review.
This is the time where you can request any changes to the design and colours. Once the sketches are approved, no further changes will be made.
The same applies for agreements on animations.I kindly ask you to please be patient with your order. If I feel pressured or rushed in any way, i will see it as a violation of the Terms of Service and the commission might be cancelled. Artists are people too and sometimes unexpected hurdles occur. If there is an issue with your commission regarding completion time, I will of course communicate with you about this matter and kindly ask for your understanding.Depending on what you ordered, you will receive the full-resolution image or GIF once the piece is finished. 4. PAYMENT
All Payments are made through my Kofi-Shop or Artisttree (Paypal or Stripe needed).
The currency accepted is USD $ and Euro €.
You must pay the total price upfront!
Payment serves as a means of confirming your commission order with me.I WILL NOT PROCEED WITH THE COMMISSION IF THE PAYMENT HAS NOT BEEN RECEIVED.➥ Tipping or Donating me does not count as payment for a commission or provides favors in any way.
➥ You may only pay me until I say so and accept your comission.
5. CANCELLING/REFUNDING POILICY
❥ The artist (me) has the right to cancel and refund the money for a commission at any time if they see fit to do so.
❥ The commissioner has the right to cancel or demand a refund from the artist after the payment has been received.➥ I haven't started with the comission yet: I will refund 100% (- excluding Paypal Fees)
➥ I have started: I will send you what I have completed, charge you for the workstage that the comission is currently in and refund the remainder of the bill.
➥ Important: Animated Emotes & Illustrations + YCH Comissions aren't part of the Comissioners refund Policy. Once purchased you can not demand a refund or cancel the comission.❥ Paypal specific:
➥ If you are getting a refund, do not request a Paypal chargeback. I will transfer the money back to you myself.
➥ If you request a Paypal chargeback at any point when you were not allowed to ask for a refund you will lose all beforementioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will decline the chargeback and supply Paypal with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted for commissioning me again.NO REFUNDS OR CHARGEBACKS WILL BE GRANTED FOR ANY GIVEN REASON ONCE THE COMMISSION HAS BEEN COMPLETED
6. CUSTOMER SATISFACTION
I will do everything I can to make my customers happy!
If you have a problem with anything in regards to the commissioned piece please tell me right away so we can find a solution together.I am willing to change some of my terms for you if you ask before I start on your commission. If you, e.g., do not want me to post your art anywhere, we can discuss this.I am also always open for questions any kind regarding this TOS or my Comission Services.

But if we are currently in an Comission, I wish for you to only chat with me with the provided Chatting Option on Artisttree, per Mail or Discord and Twitter!
7. COPYRIGHT/USAGE POLICY
I retain all copyright to my art.
Therefore I am allowed to use the copyrighted artwork, like statet in 1. COMISSION to:➥ Promote myself with it.
➥ Display it everywhere to my liking (website, social media, etc.)
➥ Post it wherever I want❥ The buyer:
➥ You are allowed to repost and use the commissioned art for its intended purpose, but credit MUST be given. ➺ Link back to my Twitter and this Website.
➥ You are not allowed to make ANY changes to the artwork without my permission. (This also includes "fixing" or giving it to an another artist to "fix", rework something, etc.)
➥ Don't claim my artwork as your own.
➥ My Artworks will not be used for ANY AIs or as NFT ever!
➥ Each commission is for personal use and you are not allowed to reproduce or use the copyrighted artwork commercially (unless stated and agreed upon with the artist by buying a licence).➥ If you break the copyright infringement in any way, every right you had to the artwork will be retracted and I will make it publicly known that you are not to be trusted as a commissioner.
